Former UISD educator charged with indecency with a child by exposure

LAREDO, TX (KGNS) - A former UISD teacher who had a relationship with a 14 year old student, is heading to jail for five years, after a judge denies his request for probation.

Luis Enrique Mercado pled guilty to one count of indecency with a child by exposure.

But his lawyers, and even the victim and her family, were all asking for him to receive probation for the crime.

The hearing took several days and included testimony from Mercado himself, the girl in question, and the girl's parents.

Mercado was arrested back in May of 2015, after a school district police officer walked in on him and the 14 year old girl engaging in a sexual act in a classroom.

Several witnesses were on the stand today, Mercado's mother testified about his character.

The victim testified, saying she lied to forensics interviewer about the way she felt with Mercado, saying she lied on multiple occasions, and that she does not feel like a victim.

The girl's father also testified, saying he had forgiven Mercado, and he deserves a second chance. And that he tries to get together with Mercado and his family every week.

He asked for probation for his daughter’s sake.

Mercado testified on his own behalf, saying he knew what he did was wrong, but still engaged in it.

Even after he had been reprimanded before by district officials for hugging students in the hallways, interacting with them on social media, and having lunch with them.

In the end Judge O.J. hale sentenced Mercado to five years in prison followed by five years of probation and will have to register as a sex offender for 20 years.

A hearing for probation in the case of a former UISD educator is underway.

Luis Enrique Mercado was arrested back in May of 2015 after a UISD Police officer walked in on him and a 14-year-old engaging in a sexual act in a classroom.

Mercado has already pled guilty to one count of indecency with a child by exposure.

He is facing 10 years but his attorneys are looking for deferred adjudication.

On Wednesday, Mercado’s mother testified about his character.

The victim also testified saying she lied to forensics interviewer and that she does not feel like a victim.
