A former County Commissioner has filed a petition asking for the immediate removal of County Commissioner Mike Montemayor.
Frank Sciaraffa, who used to be the commissioner for Precinct One, says Montemayor does not live, and never has lived, in the precinct. It's one of the requirements to run for the position and because of that, Sciaraffa says Montemayor should be removed from office immediately.
He wanted Webb County Attorney Marco Montemayor to take the petition to Judge David Peeples, who is in the process of appointing a temporary replacement for Commissioner Montemayor.
Commissioner Montemayor was arrested in March on federal bribery charges.
His trial is scheduled to begin May 16th.
Numerous calls to county attorney Marco Montemayor went un-returned.
We even went to his office, but he would not comment on the petition.
