LAREDO, TX (KGNS) - Commissioner Mike Montemayor made his first public appearance since his arrest when he showed up to commissioner’s court on Thursday. The same day, Webb County Attorney Marco Montemayor filed a petition to suspend the commissioner.
"In order to protect the interest of the tax payer and obviously the county as well. Yesterday afternoon, I went ahead and ignited the process to temporarily suspend commissioner Montemayor from his position as commissioner of precinct one."
The suspension he is asking for is without pay. But it would be up to a judge to make the final decision. Marco Montemayor said as the county attorney, this is his responsibility to file this petition.
"I believe that is the fair and right thing to do, to try to have him suspended. That's our request, is to have him suspended temporarily, like I said, while the criminal case is pending. And as I stated before, the formal removal will occur at a later time and obviously a lot of that will depend on what comes out from his criminal case."
Right now, the case is pending assignment to an out of county judge. Until the judge makes a decision, Commissioner Mike Montemayor will still be in office and will be able to participate in county meetings and events. Commissioner Montemayor was arrested on March 19 on two counts of federal bribery.
If the commissioner is suspended, it will be up to the district judge who makes the ruling to appoint someone to take his place during the suspension. Webb County Judge Danny Valdez will appoint the commissioner only if Montemayor is terminated or resigns.
