Texas father found not guilty of shooting drunk driver

After three hours of deliberations, the jury acquitted David Barajas.

An intoxicated Banda struck Barajas and his two children while they pushed their disabled truck down a county road after it ran out of gas.

(NBC) - A Texas father was found not guilty of gunning down the man who killed his young sons in a drunk driving accident.

After three hours of deliberations, the jury acquitted David Barajas, who was charged in the shooting death of 20-year-old Jose Banda, Jr. in December 2012.

An intoxicated Banda struck Barajas and his two children while they pushed their disabled truck down a county road after it ran out of gas.

Authorities alleged that Barajas went home, retrieved a gun and returned to the crash site to shoot Banda in the head.
